In this week’s “From the Files of Powell and Denny,” I want to briefly review a personal injury claim which resulted from a car wreck claim we handled out of Jackson County, Alabama.
Our client was a teenager who lived on Sand Mountain, and one evening they were riding in a car in Scottsboro, Alabama when the driver lost control and the automobile they were riding in flipped over on U.S. Highway 72. The riders were shaken, but seemed to be alright and they began exiting the vehicle. Our client had just climbed out of the window on the passenger’s side and was atop of the vehicle when they were struck by a T.V.A. van. Our client was violently thrown from the top of the vehicle and suffered a closed head injury and was hospitalized at Highlands Medical Center, where she suffered seizures and had to be placed on a ventilator. When our client’s condition stabilized, she was taken to Shepherds’ Rehab. Center in Atlanta, GA for treatment of her traumatic brain injury.
Our client’s mother contacted our firm and we did our preliminary investigation into the crash, and it certainly looked to us as though there was no reason the T.V.A. van driver could not have stopped before hitting the vehicle our client was climbing out of, so we filed suit in Jackson County, AL. T.V.A. removed the case to Federal Court in Huntsville (U.S. District Court for the Northern District of Alabama, Northeastern Division). Once in Federal Court, the discovery process proceeded and we were able to establish that no other vehicles were on the road at the time of the accident, that the vehicle our client was riding in was in the middle of the road, that the accident happened on a straight away and that the T.V.A. driver appeared to be traveling at an excessive speed.
Eventually the case went to mediation before a U.S. Magistrate Judge in Jefferson County, Alabama in the City of Birmingham, and a settlement for $1,000,000.00 was reached. From the settlement proceeds, we helped our client purchase an annuity that would ensure she received monthly checks and a lump-sum that enabled her Mother to ensure she was well cared for given her injuries.
