Can I get disability benefits for Epilepsy

Can I get disability benefits for Epilepsy: Epilepsy, also known as seizure disorder, is a neurological condition which affects the nervous system. It is usually diagnosed after a person has had at least two seizures which were not caused by some known medical condition like extremely low blood sugar or alcohol withdrawal. The seizures in epilepsy may be related to a traumatic brain injury or to a congenital defect, but most often the cause of the seizures is unknown. Generally, epilepsy is not curable, but for many people it is manageable with medical care; for those whose seizure disorder is not manageable with medical treatment, Social Security Disability benefits may be appropriate.

The Social Security Administration lists Epilepsy (both convulsive and non-convulsive) as a condition which can be disabling when the symptoms interferes with the person’s ability to engage in sustained work activity. Listing 11.02 in the Code of Federal Regulations lays out in specifics the impairments which a sufferer has to have in order to qualify for Social Security Disability Benefits for this condition; however, if you do not “meet or equal” this listing, you may still be entitled to disability benefits if your condition, in conjunction with any other physical or mental impairment, prevents you from returning to work you have done in the past and other substantial work you might be qualified to perform given your age, education and acquired work skills.

Many times when we represent people who suffer from epilepsy/seizure disorder, we have a family member appear at court to testify as to the frequency of the attacks and the attacks manifestations as the person who is suffering may not recall them, so you may want someone to come with you to explain your condition when you meet with an Alabama Disability Attorney.

If you or a loved one lives in Alabama, you are suffering from the effects of Epilepsy and you believe you are disabled as the result and are entitled to Social Security Disability or SSI benefits, you do not have to take on the Social Security Administration alone. Please feel free to contact and TALK WITH one of the experienced Alabama Disability Attorneys at Powell and Denny today.
