Alabama Workers Compensation Claims  Why you should talk with a Lawyer

It happens all too often.  An injured worker contacts Powell and Denny with questions about their Alabama Workers Compensation claim, and after a few questions, it becomes apparent that the injured worker has been taken to the cleaners by the workers’ compensation insurance adjuster.

A few years ago, I was talking with a defense attorney who told me about a settlement the pushed through for his client-the workers comp insurance carrier.  They said they felt horrible getting the case settled because the injured worker was being ripped off.  The injured worker needed back surgery, but the adjuster convinced them that their case was a bad one and they settled our all aspects of their case-including their right to medical care-for $5,000.00.

Just a few moments ago I got off the phone with an injured worker who suffered a bad hip injury a few years ago.  They needed hip surgery, but instead of receiving the medical treatment (and compensation) they deserved, they were asked to come into Birmingham, where they were given $3,000.00 and they settled their claim before an Ombudsman.  This person was not even aware that they had settled their claim until we contacted the Alabama Department of Labor to check on it for them.  Instead of receiving the care and compensation they deserved, this injured worker was given a few thousand dollars and ended up having to apply for Social Security Disability.

Most of us cannot fathom intentionally trying to take advantage of someone else, much less someone with a serious injury and a legal right to Alabama Workers’ Compensation benefits-but you have to remember that a workers compensation adjuster or Case Nurse Manager do not have your best interest in mind.  Their obligation is to the insurance company, and the less money they have to pay, the better for them.

Not every adjuster or Case Nurse Manager goes out of their way to take advantage of an injured worker-but it happens much more than you would hope.  That is why, if you have suffered a job injury and have a right to Alabama Workers’ Compensation benefits-you should at least call and speak with an attorney whose practice is focused on workers comp cases.
